public hearing before the cameras with a warrant?
I have a question for my task that can not seem to find. If someone could help me to respond to really appreciate it. Question: Judge Jones is to hear a motion to order release of substance abuse records pursuant to an order of appearance. The audience … A. Must be in open court, because the records were subpoenaed. B. It may be in open court at the discretion of the judge. C. Must be heard in the chambers and sealed from public scrutiny. D. Can be heard in chambers if the motion so ordered. This is for my kind of confidentiality of information health. If someone told me it should be, and why, I would really appreciate the help and explanation. Thanks in advance!
A. The records may is that it has information that is protected by the privilege of either doctor or patient status as HIPAA, both to prevent dissemination of personal health information. However, if lawyers are not going to discuss the content of the records in an open, fair request to produce, is a movement on par with any other movement. Unless there is some compelling reason to seal the proceedings, the judge will not.
